Preparing to Mediate

  • Gather all pleadings related to current litigation
  • Gather all prior court orders including agreements such as MDAs incorporated into orders
  • If money will be discussed bring documentation of all figures 
  • If individual incomes are at issue bring the past 2 years income tax records.
  • Review and sign the handbook supplied by Mediation Services
  • Consider listing issues you wish to discuss on paper
  • If vacation or holidays will be discussed (for parenting plans) be sure to find out what school and employer's policies are and if sports, camps or other activities might be involved make sure to note these dates and times
  • Review agreement to mediate supplied by Mediation Services
  • Be certain that party with authority to resolve issue will be present at mediation
  • Clear your calendar for 4 hours at the scheduled time and turn off your cell phone
  • Talk with attorney about legal rights and best and worst case scenarios if litigating
